Terms & Conditions
Please read this Agreement carefully before buying our plugin(s). By purchasing any of our plugins, you agree to become bound by the Terms of this Agreement. If you do not agree to all the Terms of this Agreement, then you may not purchase our plugins. If these Terms are considered an offer by Starfish, acceptance is expressly limited to these Terms.
If you are under 13 years old, please do not register on our site or purchase our plugins. Any person who registers as a user or provides their personal information to Starfish, represents that they are 13 years of age or older.
1. Code Licensing
All of Starfish’s plugins and add-ons, unless otherwise stated, are licensed under the GNU General Public License version 2.0 or later.
We reserve the right to change pricing at any time for any reason, including temporary discounts and limited or unlimited-use coupons. We reserve the right to not honor typographical errors which may cause incorrect pricing on the website.
3. Plugin Licenses
Purchase of a license grants each customer a non-transferable API Key license (“license”) to automatic updates and support for the associated plugin or software as defined by the plugin level (eg. Business, Webmaster) that was purchased. It also grants each customer access to download the latest version of the plugin associated with that license via our website.
Licenses are only valid for the time paid for (typically 1yr) and are invalidated at the end of the purchase term, if not renewed for any reason. The customer/license-holder (“customer”) may not resell or sub-license the license to any person or entity. Starfish will only provide automatic updates and support to the original customer with a legitimate and current license key, and consider any other uses of this license key for automatic updates or support as fraudulent.
All plugins are property of Starfish. Claiming any ownership rights of our products is strictly prohibited.
Our plugins are provided “as is” without warranty of any kind, expressed or implied. We shall not be liable for any damages, including but not limited to, direct, indirect, special, incidental or consequential damages or losses that occur due to the use or inability to use our plugins.
All site content, including imagery and documentation that is published on StarfishWP.com is the property of Starfish. Any replicated site content must be authorized in advance. Content from this site shall not be used or exploited for commercial or non-commercial purposes without the prior written consent of Starfish.
After processing a customer’s payment successfully, they will receive an email with their purchase information. Their license key(s) are available in their account area along with their associated plugin downloads. If you are a customer and are unable to access these for any reason, please contact us.
Starfish, sells and distributes plugins “as is” and with no implied meaning that they will function exactly as you would like, or that they will be compatible with all third-party components and plugins.
Plugin licenses are sold as automatically recurring subscription that renews each year on or close to the anniversary of the purchase date. This subscription will automatically renew unless canceled by the customer. If the customer chooses to cancel their subscription, or their subscription payment fails to process for any reason, their license will expire at the end of the purchased term. If the license is renewed, then the license and associated API Key(s) remain valid for another year.
Support for plugins sold and distributed by Starfish, is only available for those who have an active, paid license.
Support and updates are granted for one year after the original purchase based on the license the customer has purchased. After one year is completed, the customer must allow, or (in instances where payment fails) facilitate the renewal of their license in order to continue receiving support and updates for the plugin(s) purchased. For purchases that include an automatically renewing subscription, support will be provided for as long as the subscription remains active.
Support and updates for Starfish plugins are provided as long as they are actively in development. Should any one of the following occur, Starfish will no longer be responsible for providing support for one or all of their plugins:
- An individual plugin is no longer actively developed as a viable product under Starfish.
- Starfish or the parent company is purchased or bought out by another company.
- WordPress is no longer actively developed.
While we attempt to provide the best support possible for our plugins, we do not guarantee that any particular support query can, or will be answered to the extent, or within a timeframe that the inquirer is completely satisfied.
Our plugins are guaranteed to function on a clean install of the most recent stable version of WordPress, and one version previous (eg. if 6.6.2 is the current stable version, we also guarantee them to work on all 6.5.x versions), using the default theme for that version. We do not guarantee that the plugins will function with all third-party plugins, themes, or browsers. We are not responsible for any conflicts or compatibility issues that may occur due to third-party software. We assume no responsibility for any data loss as a result of installing or using one or more of our plugins. Should conflicts occur with third-party software, we may provide support at our discretion. Additionally, we are not liable and will not be held responsible for any indirect, special, incidental, or consequential damages, personal loss, site damage, site errors, theft, fraud, loss of profits or revenue, loss of business or opportunities, or loss of customers or clients as a result of installing or using one of our plugins.
We will provide a refund within 30 days of a customer’s original purchase if they request it. We will consider a refund for an annual subscription renewal, within 15 days of that renewal. Refund requests must include the license key, transaction ID, the date of purchase and the purchaser’s email address. Requests with incomplete or inaccurate information will be disregarded. Refunds are not available for product upgrades, downgrades, early termination, un-applied coupon codes or discounts, etc. Partial refunds for those situations are not available either. By upgrading the software license, the customer agrees they have had a reasonable opportunity to inspect the goods/software and signifies to the seller that the goods are conforming or that the buyer will take or retain them in spite of their nonconformity. At that point (even if the upgrade was within 30 days of the original purchase date) any upgrade amounts paid as well as the original purchase amount are no longer eligible for a refund. Refund requests may take up to 14 days to process. All refunds will be granted at the sole discretion of Starfish. Absolutely no refunds will be given after 30 days from the original purchase or 15 days from a renewal. Please note that by purchasing the plugin, you agreed to these terms & conditions of use including this Refund Policy. We reserve the right to change or modify the current refund policy with no prior notice.
Starfish may occasionally send you emails related to the purchase of products from our company. These transactional emails may include notification of licensing changes, changes to our terms and conditions, license expiration notices, and other transactional emails related to your purchase of our plugin(s). By purchasing our plugin(s) you agree to receive these transactional emails. If you sign up for one or more of our email newsletters, we will also send you occasional email newsletters relating to plugin updates, promotions, tips, tricks, etc. We will never sell or release your email to any third party vendors. You may opt out of these newsletter emails at any time without penalty.
